Yahoo! Text Subscriptions Terms of Service
1. ACKNOWLEDGMENT AND ACCEPTANCE OF YAHOO! TEXT SUBSCRIPTIONS TERMS OF SERVICE
Welcome to the Yahoo! Text Subscriptions service (the "Subscriptions Service"), which is owned and operated by Yahoo India Private Limited ("Yahoo!", "we" or "us" as the case may be), a subscription service through which registered Yahoo! Text Subscriptions users can receive SMS alerts on their mobile phones for the service they have subscribed to.
The Subscriptions Service is provided to you under the terms and conditions of these Yahoo! Text Subscriptions Terms of Service and the Yahoo! India Terms of Service (collectively the "Agreement"). In the event and to the extent of any inconsistency between these Yahoo! Text Subscriptions Terms of Service and the Yahoo! India Terms of Service, the former shall prevail.
Please note that where applicable, the terms of your agreement with your carrier will also apply to your use of the Subscriptions Service.
For avoidance of doubt, the Subscriptions Service forms part of the "Service" as defined in the Yahoo! India Terms of Service. We may update and change the Agreement from time to time without notice to you. You can review the most current version of these Yahoo! BY SENDING ANY OF THE "JOIN" KEYWORDS TO SUBSCRIBE TO THE SUBSCRIPTIONS SERVICE, AND/OR BY CONTINUING TO USE THE SUBSCRIPTIONS SERVICE, YOU AGREE TO BE BOUND BY THE AGREEMENT, SO PLEASE READ THESE YAHOO! TEXT SUBSCRIPTIONS TERMS OF SERVICE AND THE YAHOO! INDIA TERMS OF SERVICE CAREFULLY.
2. YAHOO! TEXT SUBSCRIPTIONS
In order to sign up for the Subscriptions Service, you must have a working and valid mobile phone number or other telephone number associated with any device that is capable of receiving and sending SMS messages ("Designated Number"), and for that phone number be a customer of a carrier with whom the Subscriptions Service is available.
You agree that you are duly authorised to provide to us all information provided by you, including the Designated Number. If you provide any information that is untrue, inaccurate, not current or incomplete or that you are unauthorised to provide, or Yahoo! has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete or that you are not authorised to provide such information, Yahoo! has the right to terminate your account and refuse any and all current or future access to or use of the Subscriptions Service without any liability to you.
3. CHARGES, RENEWALS AND PAYMENTS
The Subscriptions Service is provided on a subscription basis. Pricing and usage packages vary from carrier to carrier, so please check with your carrier for further details. As the Subscriptions Service is provided on a subscription basis, SMS messages sent to you (MTs) as part of the Subscriptions Service will not (unless your prior consent is obtained) be subject to additional charges over and above the subscription charges. SMS messages sent by you (MOs) in connection with the Subscriptions Service (whether to use, to request for or to terminate the Subscriptions Service or otherwise) will be subject to your carrier's usual premium (P2A) SMS charges, if any.
The Subscriptions Service is provided on a 30-day basis, commencing on the date that you sign up for the Subscriptions Service. Your subscription to the Subscriptions Service will be automatically renewed after every 30-day subscription period, at the then-current subscription charge applicable to your carrier. You may unsubscribe from the Subscriptions Service by sending an SMS message containing the relevant unsubscribe command to your carrier. If you choose to unsubscribe from the Subscriptions Service, the Subscriptions Service will continue to be provided to you for the remainder of the then-current 30-day subscription period.
Please note that all fees and charges paid or payable by you in respect of the Subscriptions Service are strictly non-refundable or will remain payable (as the case may be), even if you unsubscribe from the Subscriptions Service before the expiry of your then-current 30-day subscription period.
4. COMMUNICATIONS
You acknowledge that as part of the Subscriptions Service, you will receive, and you hereby agree to receive, SMS messages sent by or on behalf of Yahoo! to you in connection with the Subscriptions Service. You also acknowledge that we may send, and you hereby agree to us sending, these alerts to you at all times between 7am to 8pm IST, depending on the specific service to which you have subscribed.
5. TERMINATION
Yahoo! may, but has no duty to, immediately terminate your subscription to the Subscriptions Service, if we in our sole discretion conclude that you have provided false information in connection with your subscription, are engaged in fraudulent or illegal activities, or are engaged in activities that may damage the rights of Yahoo! or any other persons. In addition, Yahoo! may immediately terminate your subscription to the Subscriptions Service, if you fail to abide by the terms of this Agreement.
Termination by Yahoo! under this section is without any liability to you, and any and all subscription charges paid or payable by you in respect of your subscription up to such termination will not be refunded or will remain payable, as the case may be.
6. DISCLAIMER OF WARRANTIES
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
(A) YOUR USE OF THE SUBSCRIPTIONS SERVICE IS AT YOUR SOLE RISK. THE SUBSCRIPTIONS SERVICE IS PROVIDED ON AN "AS IS" BASIS. YAHOO! EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
(B) YAHOO! MAKES NO WARRANTY THAT (i) THE SUBSCRIPTIONS SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SUBSCRIPTIONS SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SUBSCRIPTIONS SERVICE WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SUBSCRIPTIONS SERVICE WILL MEET YOUR EXPECTATIONS, AND (V) ANY ERRORS OR DEFICIENCIES IN THE SUBSCRIPTIONS SERVICE WILL BE CORRECTED.
7. RESERVATION OF RIGHTS
The Subscriptions Service and its benefits are offered at the sole discretion of Yahoo!, and Yahoo! has the right to modify or discontinue, whether temporarily or permanently, the Subscriptions Service, in whole or in part for any reason, at our sole discretion, with or without notice to you. You agree that Yahoo! will not be liable to you or any third party for any modification or discontinuance of the Subscriptions Service.
8. INVALIDITY OF SPECIFIC TERMS
If any provision of these terms or any document incorporated by reference is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of such documents remain in full force and effect.
9. GOVERNING LAW AND JURISDICTION
These Yahoo! Text Subscriptions Terms of Service and the relationship between you and Yahoo! shall be governed by the laws of the Republic of India without regard to its conflict of law provisions. You and Yahoo! agree to submit to the personal and exclusive jurisdiction of the courts located at Mumbai, India.
